Terms of Service
1. Acceptance of Terms
By accessing and using the DGFV service (the "Service"), including the free public flight visualization tool and/or any paid embed licenses (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Agreement"). If you do not agree to these terms, you may not use our Service.
These Terms of Service constitute the entire agreement between you and SiteClaw LLC (the "Company," "we," "us," or "our") regarding the provision of the Service, superseding any prior agreements or understandings. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Services
DGFV is a 3D disc golf flight visualization tool offered in two distinct usage modes:
2.1 Free Public Tool
A free, ad-free visualization tool available at dgfv.io that allows individual disc golfers to:
- Visualize disc flight paths in 3D
- Input disc characteristics and throwing conditions
- Analyze flight behavior for learning and equipment selection
- No account required
- No payment required
- Unlimited access
The free public tool is provided "as-is" without service level guarantees. Features and functionality may change without notice.
2.2 Paid Embed License
A business-to-business SaaS offering for disc golf retailers and product manufacturers to embed the DGFV visualization tool on their websites and product pages. Two service tiers are available:
Pro Tier — $149/month: Single domain embed license, standard branding (Powered by DGFV attribution required), email support (24-hour response time, business hours), access to standard disc catalog, HTTPS iframe/script embed only, monthly billing via Stripe.
Enterprise Tier — $499/month: Unlimited domain embed licenses, white-label option, priority support (4-hour response time, 24/7), custom disc catalog management, API access for advanced integrations, dedicated account management, monthly billing via Stripe.
3. User Accounts and Responsibilities
3.1 Free Public Tool — No Account Required
The free public tool at dgfv.io requires no account creation or login. You may use this tool anonymously without providing any personal information.
3.2 Paid Embed License — Account Creation
To access paid embed services, you must create an account or be designated as an authorized user on an account. You agree to provide accurate and complete business information, maintain the confidentiality of all API keys and credentials, immediately notify us of any unauthorized use, and accept full responsibility for all activities occurring under your account.
4. Intellectual Property Rights
4.1 Your Content
You retain all intellectual property rights to any content you provide to us. By providing Your Content to us for use within DGFV, you grant SiteClaw LLC a worldwide, non-exclusive, royalty-free license to use, display, process, and reproduce Your Content solely for the purpose of providing the Service.
4.2 Our Intellectual Property
SiteClaw LLC retains all rights to the DGFV visualization software, code, algorithms, architecture, design, interface, graphics, user experience elements, the default disc flight database, flight simulation models, and any pre-existing intellectual property.
5. Payment Terms and Billing
Pricing for paid embed licenses is outlined in your Service Agreement. Services are billed monthly in advance via Stripe. Invoices are due within 15 days of issue (Net 15). Accounts more than 30 days past due are subject to a late fee of 1.5% per month. Accounts more than 60 days past due may have their embed license suspended.
6. Acceptable Use Policy
Users agree not to use DGFV for any illegal activities, conduct automated scraping or data extraction, reverse-engineer or attempt to access underlying code, interfere with or disrupt the service, use bots or automated tools to simulate multiple users, or sublicense, resell, or redistribute the tool or its data.
7. Service Uptime and Availability
For the free public tool, we strive for maximum uptime but do not provide service level guarantees. For paid embed licenses, we commit to a best-effort target of 99.5% uptime measured monthly.
8. Limitation of Liability
SiteClaw LLC provides DGFV "AS IS" without warranties of any kind. To the fullest extent permitted by law, neither SiteClaw LLC nor its officers, directors, employees, agents, or service providers shall be liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Our total liability shall not exceed the total fees paid in the 12 months preceding the claim, or $500, whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless SiteClaw LLC from any claims, damages, losses, costs, or expenses arising from your use or misuse of DGFV, your violation of these Terms, or your violation of any applicable law or third-party rights.
10. Embed-Specific Terms
Pro Tier: You must display and maintain the "Powered by DGFV" attribution. Enterprise Tier: You may customize branding as specified in your Service Agreement. You must implement the embed exclusively using the provided HTML iframe or JavaScript snippet methods.
11. Data Protection and Privacy
Your use of DGFV is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
12. Termination
Free public tool users may stop using the Service at any time. Paid embed license customers may terminate by providing written notice to andrew@siteclaw.io. We may terminate your Service immediately without notice for material violations.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Michigan. Any dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
14. Modifications to Terms
SiteClaw LLC reserves the right to modify these Terms at any time. We will notify you of material changes via email or by posting an updated version at dgfv.io/terms.
