Terms of Service
1. Acceptance of Terms
By accessing and using the DGFV service (the "Service"), including the free public flight visualization tool, the free embeddable version described in Section 2.3, and/or any paid embed licenses (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Agreement"). If you do not agree to these terms, you may not use our Service.
These Terms of Service constitute the entire agreement between you and SiteClaw LLC (the "Company," "we," "us," or "our") regarding the provision of the Service, superseding any prior agreements or understandings. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Services
DGFV is a 3D disc golf flight visualization tool offered in the usage modes described below:
2.1 Free Public Tool
A free, ad-free visualization tool available at dgfv.io that allows individual disc golfers to:
- Visualize disc flight paths in 3D
- Input disc characteristics and throwing conditions
- Analyze flight behavior for learning and equipment selection
- No account required
- No payment required
- Unlimited access
The free public tool is provided "as-is" without service level guarantees. Features and functionality may change without notice.
2.2 Paid Embed License
A business-to-business SaaS offering for disc golf product manufacturers and retailers to embed the DGFV visualization tool on their websites and product pages. Current service tiers, their features, and pricing are those published at dgfv.io and set out in your Service Agreement. The tiers are summarized below; the pricing then in effect at dgfv.io applies.
Brand Catalog: The core manufacturer license. A fully white-labeled embed with no DGFV branding, your full catalog presented as a browsable 3D flight library, brand-color theming, and per-mold embeds across your product pages, billed monthly or annually via Stripe, as selected at checkout. Founding Partner pricing may apply for a limited time as published at dgfv.io.
Enterprise: Everything in Brand Catalog, plus API and script-tag embedding for custom integration, per-embed usage analytics, per-mold accuracy tuning, and priority support, billed monthly or annually via Stripe, as selected at checkout. Per-embed usage analytics is on the roadmap and is not yet shipped; analytics and per-mold accuracy tuning are provided as available and confirmed in writing.
Retailer: The license for online disc shops. Every brand you stock is browsable in one embed on your site, themed to your accent color, with setup done for you. The embed keeps its visible "Powered by DGFV" attribution. Usage statistics for your embeds are provided as available and confirmed in writing. Billed monthly via Stripe.
2.3 Free Embed
DGFV offers a free embeddable version of the DGFV visualization tool (the "Free Embed") that a business may place on its own website using the snippet builder at dgfv.io/examples/embed-builder.html. The Free Embed is licensed, not sold, and remains DGFV's property. It carries a visible "Powered by DGFV" attribution that links to dgfv.io. Use of the Free Embed is subject to Section 10 and may be revoked by DGFV for any site at any time by disabling the embed for that site.
3. User Accounts and Responsibilities
3.1 Free Public Tool (No Account Required)
The free public tool at dgfv.io requires no account creation or login. You may use this tool anonymously without providing any personal information.
3.2 Paid Embed License
A paid embed license does not create a user account and there is no password to manage. Your license is recorded in DGFV's host registry as the website domains it covers and, where a browser cannot report the embedding domain, an opaque license id that we issue to you and that you place in your embed code. You agree to provide accurate and complete business information, keep your registered domains and billing contact current, treat any license id we issue as specific to your registered sites, notify us immediately if your license id or embed appears on a site you do not control, and accept full responsibility for use of the embed on your registered domains. When an Enterprise API is offered, you must also keep any API keys we issue confidential and notify us immediately of any unauthorized use of them.
4. Intellectual Property Rights
4.1 Your Content
You retain all intellectual property rights to any content you provide to us. By providing Your Content to us for use within DGFV, you grant SiteClaw LLC a worldwide, non-exclusive, royalty-free license to use, display, process, and reproduce Your Content solely for the purpose of providing the Service.
4.2 Our Intellectual Property
SiteClaw LLC retains all rights to the DGFV visualization software, code, algorithms, architecture, design, interface, graphics, user experience elements, the default disc flight database, flight simulation models, and any pre-existing intellectual property.
5. Payment Terms and Billing
Pricing for paid embed licenses is outlined in your Service Agreement. Services are billed in advance via Stripe, monthly or annually as selected at checkout. A subscription started through a Stripe checkout is charged in advance to the payment method given at signup and on each renewal. Where DGFV agrees to invoice an account instead, invoices are due within 15 days of issue (Net 15). Accounts more than 30 days past due are subject to a late fee of 1.5% per month. Accounts more than 60 days past due may have their embed license suspended.
6. Acceptable Use Policy
Users agree not to use DGFV for any illegal activities, conduct automated scraping or data extraction, reverse-engineer or attempt to access underlying code, interfere with or disrupt the service, use bots or automated tools to simulate multiple users, or sublicense, resell, or redistribute the tool or its data.
7. Service Uptime and Availability
For the free public tool, we strive for maximum uptime but do not provide service level guarantees. For paid embed licenses, we commit to a best-effort target of 99.5% uptime measured monthly.
8. Limitation of Liability
SiteClaw LLC provides DGFV "AS IS" without warranties of any kind. To the fullest extent permitted by law, neither SiteClaw LLC nor its officers, directors, employees, agents, or service providers shall be liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Our total liability shall not exceed the total fees paid in the 12 months preceding the claim, or $500, whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless SiteClaw LLC from any claims, damages, losses, costs, or expenses arising from your use or misuse of DGFV, your violation of these Terms, or your violation of any applicable law or third-party rights.
10. Embed-Specific Terms
Retailer Tier: You must display and maintain the "Powered by DGFV" attribution. Brand Catalog and Enterprise Tiers: The embed is white-labeled and you may customize branding as specified in your Service Agreement. You must implement the embed exclusively using the provided HTML iframe or JavaScript snippet methods.
Free Embed: The Free Embed displays one disc mold per page. You must keep the "Powered by DGFV" attribution visible and unobstructed wherever the Free Embed appears. You may not cover, crop, overlay, hide, restyle, or remove it, including by modifying, proxying, or self-hosting any part of the visualization tool. You may not use the Free Embed to present DGFV's flight data or 3D flights as your own product or under another brand. Catalog browse (a single embed presenting more than one mold, whether locked to one brand or covering several), theming, white-labeling, catalog curation, and analytics are available only under a paid tier. A request for a feature outside the Free Embed is served as the Free Embed rather than refused, so the visualization tool continues to work on your page. DGFV may disable the Free Embed for any site that breaks these terms and may pursue the remedies in Section 12.
11. Data Protection and Privacy
Your use of DGFV is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
12. Termination
Free public tool users may stop using the Service at any time. Paid embed license customers may terminate by providing written notice to andrew@siteclaw.io. We may terminate your Service immediately without notice for material violations.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Michigan. Any dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
14. Modifications to Terms
SiteClaw LLC reserves the right to modify these Terms at any time. We will notify you of material changes via email or by posting an updated version at dgfv.io/terms.
